participate in the martial arts instructional training opportunity presented as the 2022 Midwest Bujinkan Tai Kai (“Taikai”). I understand and acknowledge that participation in Taikai includes interaction with Taikai’s Hosts (“Hosts”) including but not limited to Nathan W Metz, Zentai LLC, Taikai staff, volunteers, representatives, agents, owners of the property on which Taikai is taking place and any persons in charge of any such establishment(s) or organization(s), as well as property owner’s agents, servants, and employees. I also understand and acknowledge that participation in Taikai includes interaction with individuals and groups participating in marital arts instructional training but are not in charge of Taikai instruction or administration (“Participants”).  I assert that I will strictly abide to all terms of this Release of Liability and Training Agreement (“Agreement”). 

II. PHYSICAL AND EMOTIONAL FITNESS  I assert that I am physically and emotionally fit to engage in martial arts instructional training with no pre-existing medical or mental conditions. I also acknowledge that the Hosts or Participants are under no obligation to require me to prove my degree of health and fitness.  

III. VIGOROUS PHYSICAL MOVEMENT AND BODILY CONTACT  I acknowledge that participation in Taikai includes vigorous physical movement conducted by myself, Hosts and Participants individually, with or without training equipment. I also acknowledge that participation in Taikai includes vigorous physical movement conducted by myself, Hosts and Participants with each other, with or without training equipment. I acknowledge that participation in Taikai will include bodily contact with Hosts, Participants and training equipment, and that such bodily contact could lead to injury including but not limited to physical and mental discomfort, temporary or permanent impairment, or even death.  

IV. RISK OF BODILY INJURY OR DEATH  (a) Due to the inherently dangerous nature of martial arts instructional training, I acknowledge that participation in Taikai exposes me to the RISK OF SERIOUS BODILY INJURY OR EVEN DEATH. By signing this Agreement, I knowingly and willingly assume all risk of injury or other damage, including but not limited to damage to personal property, physical and mental discomfort, temporary or permanent impairment, or even death. By signing this Agreement, I also knowingly and willingly waive any and all claims whatsoever that I or anyone else on my behalf may or could assert with respect to such injury or damage(s), even if such injury or damage(s) arouse out of possible negligence, unavoidable accident, or any other reason due to the inherently dangerous nature of martial arts instructional training.  (b) I fully understand that I may withdraw from participating in any and all exercises or techniques conducted within Taikai at any time; I acknowledge that it is my personal responsibility to decide which exercises or techniques I will choose to participate in.  

V. CONDUCT IN TAIKAI  If my conduct, actions, or statements while participating in Taikai are determined by any Host(s) to be inappropriate to the safety or well-being of any Hosts or Participants, I understand and agree that I will be immediately asked to leave Taikai and forfeit any claims to monies paid for participation within Taikai without recourse for recovery. I understand and agree that Hosts will not be held liable for any injuries or damages caused by or resulting from negligence of the Hosts or Participants and I covenant not to sue and waive and release Hosts and Participants from any responsibility for personal injury to myself. 

VI. CONSTRUCTION OF AGREEMENT  (a) The parties may only amend or modify this Agreement by a written Agreement dated and signed by them. No oral agreement will be effective. (b) The provisions of this Agreement will not be subject to subsequent modification by any court except by mutual consent of the parties. (c) The terms of this Agreement contain the entire understanding of both parties. No other term not provided within this Agreement has been made by one party to the other. (d) If any part of this Agreement is held to be invalid, the remaining parts of this Agreement will not be affected. (e) Photocopies of this Agreement can be relied upon as though they were originals (f) This Agreement will be construed under the general laws of the State of Ohio.  (g)  Nothing in this Agreement will impair compliance with federal laws or laws of the State of Ohio. (h) The captions are for convention only and are not intended to limit or define the scope of any provision. (i) Any word in the extent of this Agreement will be read as singular or plural, and as masculine, feminine, or neutral gender, as may be appropriate under the circumstances to carry out the parties' intent. (j) No delay or failure of either party to exercise any right under this Agreement, and no partial or single exercise of that right, will constitute a waiver of that or any other right, unless otherwise expressly provided within this Agreement.  (k) This Agreement is binding on and to the benefit of the parties, and their respective heirs, legal representatives, successors, and assigns.
